ROYAL DECREE 1133/2002
Chapter I
 Article 1- Object
 Article 2- Purebred Equestrian Breed and Registered Horses
 Article 3- Stud Book
1. There shall be a genealogical book (stud book) for each breed……
2. ….which will be handled/managed by an official service to perform the following:
  a. Develop and handle the genealogical book (studbook) for purebred horses.
  b. Inscribe purebred horses in the said register…..
  c. Identify and grade the said animals.
  d. Establish the types and procedures for the evaluation and/or grading of horses to be used for reproduction.
  e. Cooperate with the recognized breeder associations to elaborated and execute the selection and improvement plan, backed by the advice of some type of scientific entity…..
  f. Define the norms for contests and competitions, in conjunction with the recognized breeder associations…
  g. Perform the control of production, linage, and parent/offspring relationship.
  h. Elaborate a list of breeders…..
  i. Establish the birth, service, artificial insemination, ovule, or embryonic transplant, inscription, evaluation certificates, and other identification documents foreseen in this present Royal Decree or in the European Union norms and laws.
  j. ……

3. …..the independent entity, "Fondo de Explotación de los Servicios de Cria Caballar y Remonta" (National Breeding Authority) within the Ministry of Defense, is the entity appointed by the Ministry of Agriculture, Fisheries and Food as the official State service……
Article 4- Division of the Genealogical Book
1. The genealogical book (stud book) shall include at least the following registers:
  a. Birth register……
  b. Main register…… i. Register of qualified horses for reproduction ii. Register of elite horses for reproduction
2.
  a. …..
  b. Functional Register: for newly created stud books, which have no registered horses, where all those horses that meet the minimal characteristics for the recuperation of the breed or the established conditions as ruled for the launching of a new register.
  c. Register of Merits: in which horses are registered that, in addition to complying with the requirements established in article 8.1.a, have proven to have outstanding conformational and functional qualities.
Chapter II
Article 6- Identification of animals
1. Horses must be described and have an identification document that includes minimum data, which appears in the Appendix of this present Royal Decree…..
2. For all horses born as of January first of 1998 (1-1-1998), shall have a passport, as established by European Union law 93/623/CEE by the Commission, on the 20th of October of 1993…..
3. All equine animals….shall be described upon birth. The description shall be made by an official veterinarian, or a person who has been authorized by the Authorities for that particular task, with the foal next to the mother and prior to weaning, and at the same time, implanting an electronic identification system,…. and blood samples shall also be taken for genetic markers. The microchip shall be placed on the left side of the (horse's) neck….
Article 7- Inscription of equines in the genealogic book (studbook)
1. Only those horses that meet the characteristics established in this Royal Decree shall be inscribed in the corresponding Stud Book; the origin and genealogy of the said horses must be duly confirmed.
2. In the birth register of the stud book….horses that comply with the following aspects …shall be inscribed:

  a. If born of registered parents, inscribed in the breed studbook….which is handled by an official service or by an officially recognized association or organization….
  b. If the mare has been serviced (covered) by the stud (sire stallion at the service appointment)….and the foal has been certified by a veterinarian by means of documents or certificated established for this purpose.
  c. If identified as established in Article 6 of this present Royal Decree.
  d. If the relationship is verified by means of genetic marker analysis….
  e. If the said inscription in the studbook has been petitioned within a maximum of six months after foaling.
3. The initial inscription as a horse for reproduction shall be for those horses that fail to meet the requirements of the previous section, but that are authorized for reproduction and registered in the specific stud book if there is compliance with the following conditions:
  a. Be identified as established in Article 6.
  b. To have surpassed the conformation and functional conditions as established by the studbook
  c. To have been accepted by the entity that handles the studbook
Article 8- Evaluation of Studs/broodmares
1.….equines will be subject to an evaluation to establish their genetic and reproductive qualities, with the following categories.
  a. ….
  b. …. Animals may be considered elite studs/broodmares that, although they are not included in the register of qualified stud/broodmares, have had descendents with outstanding merits in sports, within the framework of the breed improvement plan.
2. Animals that have been classified as apt for reproduction purposes based on previous norms, prior to the application of this Present Decree will figure in the main register.
Article 9- Selection Outline and Improvement Plan
1.1. the results of the evaluation of studs/broodmares and performance control shall be integrated into the selection outline and improvement plan, which allows for the objective evaluation of the animals, in an effort to achieve genetic improvement in purebred horses.
2. The selection outline and the improvement plan for purebred horses shall be developed jointly with the official service and by the recognized breeder associations and shall be analyzed by the General Commission of the Equine Stud Books, and shall be approved by the Ministry of Agriculture, Fisheries and Food.
Article 10- Control of Performance
  a) Testing will be carried at the performance control stations or authorized training centers…..on a series of animals that will be subject to a series of established tests to learn about their aptitudes.
Article 11- Appeals
1. In the light of the decisions made by the entity that handles the genealogical register of horses (stud book), within the framework of the regulations of this current Royal Decree, an administrative appeal may be presented…..
2. …..before the Director General of Horse Breeding of the Ministry of Agriculture, Fisheries, and Food.
Chapter III
Article 12- General Commission of Equine Genealogical Books
1.1. the results of the evaluation of studs/broodmares and performance control shall be integrated into the selection outline and improvement plan, which allows for the objective evaluation of the animals, in an effort to achieve genetic improvement in purebred horses.
2. The selection outline and the improvement plan for purebred horses shall be developed jointly with the official service and by the recognized breeder associations and shall be analyzed by the General Commission of the Equine Stud Books, and shall be approved by the Ministry of Agriculture, Fisheries and Food.
  a. President: The Director General of Horse Breeding, with voting rights
  b. Vice Presidents:
  i. First: the President of the independent entity Fondo de Explotación del Servicio de Cría Caballar y Remonta (National Breeding Authority)
   ii. Second: the Assistant Director General of Animal Food and Zoo Technology
  c. Vocals:
   i. Three vocals shall be appointed by the Ministry of Agriculture, Fisheries and Food
  ii. Three vocals appointed by the Ministry of Defense
  iii. One vocal to represent each of the national equine breeds, appointed by the officially recognized organization or associations
  d. Secretary: a civil servant from the Assistant Director General's Office of Animal Food and Zoo Technology, appointed by the Director General of Breeding with the right to express opinions and voting rights.
3. The Commission shall:
  a. Verify the working of the various books.
  c. Propose the necessary changes in the laws that regulate the selection and evaluation…..and analyze the improvement plans……
  d. Establish the applicable blood or DNA tests…
  g. Annually establish the number of mares to be services or inseminated by a single stud.
Article 14- Reference Center for reproduction and artificial reproduction methods
1.Artificial reproduction methods (artificial insemination, …..)….shall only authorized in those native breeds in which the animals are registered as classified horses for reproduction or as elite horses for reproduction, included in the main register.
Chapter IV
Article 16- Purebred Equine Breeder Organizations or Associations
1. The purebred equine breeder organizations or associations shall be officially recognized, once accredited that their existence is designed to promote and defend the purebred equine breeds and that these (entities) are open, without any type of discrimination, to the possibility of including breeders and owners of purebred equine breeds.
2. The purebred breeders' organizations or associations, which are legally recognized, will be considered representatives as interlocutor and collaborator in decision making that could affect the interests they represent, specifically in the follow-up and execution of the specific selection, improvement, and recuperation programs, and in carrying out contests, expositions, and public events.
Article 17- Competency
1.The Ministry of Agriculture, Fisheries, and Food shall be responsible for officially recognizing the equine breeder organizations or associations….
Article 19- Concession of Subsidies and Incentives
1.Administrative Concession,
  a. Due to public interest,…..the handling of the stud book could be undertaken….by a breeder organization or association, which represents the said breed. The said appointment shall be the responsibility of the Ministry of Agriculture, Fisheries, and Food after a report from the Ministry of Defense when it comes to national breeds….
  b. For each equine breed, there shall be only one recognized association or organization to handle the studbook. The concession to handle the stud book shall be granted…….to the recognized breeder association or organization…..taking into consideration the degree of representation or implantation, the impartiality to execute its functions and the capacity and the means available for the execution of the functions foreseen in this present Royal Decree.
   Third Additional Disposition
The National Breeding Authority and the concession entities to handle the purebred equine studbook may reach agreements with the official services or as the case may be, with the breeder organizations or associations of other countries to include their animals in the corresponding studbook of Spain, if and when the said organizations are legally recognized by their home countries, and comply, at least, with the conditions of article 16, and guarantee compliance with the criteria established in this present disposition.
   To carry out these agreements, the Ministry of Agriculture, Fisheries, and Food must be informed and grant a favorable decision to be executed.
   Single Repealing Disposition
The Royal Decree 1026/1993, dated 25th June, shall stand repealed. This law established the selection and reproduction of purebred equine breeds.
